The petitioners apprehend their arrest in connection with I.F. Case No. 162 of 2017, registered under Sections 9, 27, 31 and 39 of the Wild Life Protection Act, 1972. The accusation is that at about 9.00 P.M. on 02.11.2017, informant being the Banpal received information about killing of wild pig in the forest. Thereafter, he along with other forest officials entered in the forest then heard cry of the wild pig. On seeing the forest officials, miscreants started causing injury to them and tried to flee away, but anyhow out

No.29191 of 2018(2) dt.10-05-2018 2/2 of them three persons were apprehended, who disclosed their names as Indal Mahto, Styanarayan Kaji and Jagnarayan Kaji, they also disclosed the name of their Seven associates including the petitioners, who succeeded to flee away. Learned counsel for the petitioners submits that, in fact, the petitioners were not apprehended on the spot, rather their names have come in the confessional statement, who are said to be apprehended by the forest officials. The petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Bagaha, West Champaran in connection with I.F. Case No. 162 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
