JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-06-2017 The petitioner seeks regular bail in connection with Kasim Bazar P.S. case No.30 of 2017 registered for offences punishable under Sections 8/20(b) (ii) (B) of the N.D.P.S. Act, pending in the court of Sessions Judge, Munger. Allegation against the petitioner is of recovery of 3.5 kgs of ganja from his house kept in a bag.

It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner and is in custody for about four months.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegations levelled against the petitioner, I am not inclined to release the petitioner on bail at this stage. His application for grant of regular

Patna High Court Cr.Misc. No.23758 of 2017 (3) dt.20-06-2017 2/2 bail is, accordingly, rejected. The Court below is directed to take all necessary steps to expedite the trial and conclude the same preferably within a period of seven months from the date of receipt of this order, if possible concluding the trial regularly. If the trial is not concluded within the stipulated period, the petitioner may renew his prayer for bail.

At the same time, the S.P., Munger is directed to ensure the attendance of witnesses on each date, so that the trial be concluded within prescribed time.
