JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 386 and some other ancillary Sections of the Indian Penal Code. As per the prosecution case, all the FIR named accused persons, including this petitioner, assaulted the informant and his brother and looted cash of Rs. 25,00030,000/- from the cash counter of informant. Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case due to dispute of shop. As a matter of fact petitioner had taken shop on rent from late Ajay Singh, who was uncle of the informant and due to dispute of ancestral property father of the informant committed murder of elder brother of Ajay Singh in

Patna High Court CR. MISC. No.65961 of 2021(2) dt.14-07-2022 2/2 which father and mother of informant were made accused and father of informant was convicted. After partition the shop came in the share of informant and he was always putting pressure to vacate the shop. It is next submitted that petitioner has already vacated the shop. Though there is allegation of firing but there is no injury report on record. Petitioner has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts of the case, nature of accusation and clean antecedent of the petitioner, let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhojpur, Ara in connection with Ara Nawada PS case No. 655/ 2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
