The petitioner is accused in connection with Birpur P.S. Case No. 242 of 2015, registered under Sections 341, 323, 384 and 379/34 of the Indian Penal Code.

The accusation is that on 28.12.2015 after finishing the work informant had gone to Balua market and in course of returning from the market to Gammon India Company situated in Bishanpur Choudhary Camp, two persons came on motorcycle and started to abuse and took his mobile No. 8405804086 and informant was left near the camp and both miscreants returned from there. The Informant detailed the physic of the culprits. Learned counsel for the petitioner submits that it

Patna High Court Cr.Misc. No.25094 of 2016 (3) dt.03-08-2016 2/2 would appear from the F.I.R. that both miscreants after taking mobile of the informant left him near camp of Gammon India Company at Bishanpur. The informant did not disclose the name of the mobile set. After three months of the occurrence, one mobile set is said to be recovered from the possession of the petitioner by the Police, which is said to be theft mobile of the informant. While the informant has claimed to identify the culprits, but petitioner has not been put on T.I.P for identification. The petitioner having no criminal antecedent is in custody since 22.03.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M. Birpur (Supaul) in connection with Birpur P.S. Case No. 242 of 2015.
