JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-05-2017 Heard learned counsel for the petitioner, the learned A. P.P. for the State as well as learned counsel for the informant. The petitioner has moved this Court for grant of bail in connection with Deep Nagar P.S. Case No. 145 of 2016, dated 28.07.2016, registered under Sections 147, 148, 149, 448, 323, 325, and 307 of the Indian Penal Code.

It is alleged that six persons had come at the house of the informant and had caught hold of the father and mother as well as the wife of the informant. It is further alleged that the accused, namely, Yogendra Yadav and Upendra Yadav had caught hold of the informant and thrown him on the ground whereupon Dharmendra Yadav and Rajendra Yadav had assaulted the informant.

No.23495 of 2017 (3) dt.22-05-2017 2/2 The learned counsel for the petitioner submits that the allegations levelled against the accused Dharmendra Yadav and Rajendra Yadav are same and out of the aforesaid two accused persons, the co-accused namely Dharmendra Kumar @ Dharmendra Yadav has already been granted bail by a co-ordinate Bench of this Court vide order dated 29.03.2017 passed in Cr. Misc. No. 14476 of 2017.

Having regard to the facts and circumstances of the case, as stated above, this Court is of the view that in view of the parity of the case of the petitioner with that of the co-accused person who has already been granted bail, the petitioner above named is also entitled to bail and accordingly he is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rs. Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Biharsharif, Nalanda in connection with Deep Nagar P.S. Case No. 145 of 2016.
