1. No one appears on behalf of the petitioner. Mr. Chandra Bhushan Prasad, learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code.

3. The case was taken up on 19.08.2025 and the Station House Officer, Sahebganj Police Station and the Investigating Officer of the case were directed to remain physically present before the Court today at 02:15 p.m.

4. The reason for summoning the Station House Officer, Sahebganj Police Station and the Investigating Officer of the case was that the case is of the year 1997 and the petitioner in the year 2025 had approached this Court seeking anticipatory bail.

5. It was submitted on behalf of the petitioner on 19.08.2025 by the learned Senior Counsel that petitioner is not

Patna High Court CR. MISC. No.53550 of 2025(3) dt.25-08-2025 2/2 aware whether any process under Section 82 and 82 Cr.P.C. has been issued or not against the petitioner.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner and based on the instruction of the Station House Officer, Sahebganj Police Station and the Investigating Officer of the case submits that process under Section 82 of the Cr.P.C. was issued in the year 2001 and process under Section 83 was issued in the year 2007.

7. Since the process under Section 82 and 83 has been issued against the petitioner way back in the year 2001 and 2027, as such, the Court is not inclined to extend the privilege of anticipatory bail to the petitioner.

8. Hence, the prayer for anticipatory bail is rejected in connection with Sahebganj P.S. Case No. 104 of 1997 pending in the Court of learned Chief Judicial Magistrate, Muzaffarpur/Successor Court.

9. The personal appearance of the Station House Officer, Sahebganj Police Station and the Investigating Officer of the case is dispensed with.
