The petitioner seeks bail in Bhargama P. S. Case No. 89 of 2019 instituted for the offence under Section(s) 414/34 of the Indian Penal Code.

It is alleged that some iron pipe has been recovered from a tempo. The informant has alleged that aforesaid pipe were the government pipe. The driver of the tempo has been arrested by the police who disclosed his name as Md. Farooque.He disclosed the name of this petitioner who managed to run away.

It is submitted that solar plate and cutting machine has been recovered from possession of petitioner. Learned counsel for petitioner submits that those articles belong to

Patna High Court CR. MISC. No.50662 of 2019(2) dt.17-08-2019 2/2 petitioner and they were not stolen articles. The other co- accused of this case has already been granted regular bail by this Court by order passed in Cr. Misc. no. 40811 of 2019.

Petitioner is in custody since 29.5.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the JM 1st Class, Araria, in connection with Bhargama P. S. Case No. 89 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
