The petitioner is apprehending his arrest in connection with Pawana P.s.Case no.44 of 2017 registered for offences punishable under Sections 147, 148, 149 and 307 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner and other accused persons is of making firing causing injury to five persons. Submission of the learned counsel for the petitioner is that injuries are simple in nature and moreover dispute arose due to irrigation of the land.
Heard learned A.P.P. also.
Having heard both sides and in view of the fact that there is allegation of firing against the petitioner and several accused
Patna High Court Cr.Misc. No.24191 of 2018 (2) dt.02-05-2018 2/2 persons to five persons and they received injuries, I am not inclined to grant anticipatory bail to the petitioner rather let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
