Heard the learned counsel for the petitioner as well as Mr. Shahabuddin Azeem @ S. Azeem, the learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Sadar (Mabbi O.P.) P.S. Case No. 442 of 2019 registered for offence punishable under section 20 (B)/22 of N.D.P.S. Act. The learned counsel for the petitioner has submitted that co-accused Hari Nath Rai was arrested and from his possession 4 kg. 500 grams ganja was recovered. The co-accused Hari Nath Rai disclosed the name of the present petitioner. The learned counsel for the petitioner has submitted that

Patna High Court CR. MISC. No.65043 of 2021(2) dt.22-07-2022 2/2 the petitioner was not arrested at the spot and he is a person of clean antecedent. She has also submitted that co-accused Hari Nath Jha has been granted regular bail.

The learned A.P.P. has opposed the prayer for bail. Considering the above-mentioned facts and circumstances, the petitioner above-named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, N.D.P.S. Act, Darbhanga in connection with Sadar (Mabbi O.P.) P.S. Case No.442 of 2019, subject to condition as laid down under section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
