JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 01-07-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case under sections 409, 419, 420 and 471 of the Indian Penal Code on the allegation that he being In-charge Principal of Primary School, Karmatand, Police Station Sono, defalcated Rs.2,41,000/- received by him for raising Kitchen shed.

The petitioner submits that even in the investigation it has come that he has constructed the kitchen shed and the work is in progress. The petitioner further submits that he would get the work completed as per DPR approved by the Department within ten weeks.

In view of the undertaking given by the petitioner, in the event of arrest/surrender, let the petitioner, mentioned

Patna High Court Cr.Misc. No.25141 of 2016 (2) dt.01-07-2016 2/2 above, be released on bail on furnishing bail bond of Rs.7,000/- with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate, Jamui in Sono Police station Case No. 10 of 2016, one of the sureties would be in form of cash deposit.

It is made clear that authorities would ensure that the petitioner completes the work as per the DPR approved by the Department, otherwise it would be at liberty to proceed against him as per law.
