JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Warsaliganj P.S. Case No. 18 of 2017, registered for the offences punishable under Sections 341, 448, 323, 308, 379, 504, 506/34 of the Indian Penal Code. Allegation against this petitioner is that he assaulted the informant by means of rod on his head.

Submission of the learned counsel for the petitioner is that there is that there is case and counter case between the parties and opinion of injury is still kept reserve. Further submission of the learned counsel for the petitioner is that he was granted police bail and police has already filed charge sheet he has not been misused the privilege of police bail Heard learned A.P.P. also.

Having heard both sides, in view of the above

Patna High Court CR. MISC. No.55459 of 2019(2) dt.02-09-2019 2/2 petitioner is directed to surrender before the learned Court below and make prayer for regular bail which shall be considered by the learned lower court on the basis of material available on record as well as fact that he was granted police bail and he has not misused the privilege of the police bail and disposed of the same if possible on the same date.
