Patna High Court CWJC No.17550 of 2012 (19) dt.22-08-2017 2/3 filed for realization of paid amount and, therefore, there is no need to keep this matter pending.
Learned counsel appearing for the respondent no. 9 submits that vide order dated 04.04.2013 this court wanted to know as to what action was taken against the person who had passed order in L.A. Case No. 07/2008-09 and as a matter of fact, it was respondent no. 9, who had passed order in L.A. Case No. 07/2008-09. He further submits that taking note of the order dated 04.04.2013 the department has initiated proceeding and also lodged criminal case against the respondent no. 9. He further submits that earlier respondent no. 9 filed writ petition bearing C.W.J.C. No. 9676 of 2016 for redressal of his grievance as the order dated 04.04.2013 was passed without giving any opportunity of hearing to him but a co-ordinate Bench of this court dismissed the aforesaid writ petition as not pressed giving liberty to respondent no. 9 to invoke the jurisdiction of appropriate forum in accordance with law and thereafter, the respondent no. 9 filed an intervener petition which was allowed by this court vide order dated 22.02.2017.
Since there is no need to keep this matter pending, this writ petition stands disposed of.
So far as order dated 04.04.2013 is concerned, after
Patna High Court CWJC No.17550 of 2012 (19) dt.22-08-2017 3/3 disposal of this writ petition, the said order shall be deemed to have lost its effect.
