The petitioner seeks bail in a case registered for offences punishable under Sections 420, 468, 472 and 120 (B) of the Indian Penal Code.

As per the allegation, the petitioner's certificate and mark-sheet were recovered from the house in which raid was conducted.

It is contended that similarly situated several accused persons have already been granted bail. Some of the bail orders have been appended as Annexure 3, 4 and 5 series. It is further contended that the petitioner's application for grant of anticipatory bail was rejected by a coordinate Bench of this Court as well as the Apex Court. Patna High Court Cr.Misc. No.26645 of 2016 (2) dt.15-07-2016 2/2 the time of hearing from which it would appear that the petitioner withdrew his application to surrender and seek regular bail and a liberty was granted by the Apex Court that if the petitioner applies for regular bail, the application for grant of bail will be considered and decided preferably on the same day, however, his prayer for grant of bail was rejected by the court below. Learned counsel for the Economic Offence Unit submits that the petitioner's OMR sheet was found tampered. Considering the facts and circumstances of the case, the petitioner, namely, Sunil Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Patna in Economic Offence P.S. Case No.23 of 2012 (G.R. No.5265/2012).
