JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2016 Learned counsel for the petitioner is permitted to make necessary correction in para 3 of the present application. Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 392 of the Indian Penal Code.

It is alleged by the informant that while he was coming after collecting the dues along with one Dhiraj Kumar by a motorcycle, three miscreants snatched away the collecting money of Rs. 4,87,000/- and fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.02.2016. Charge sheet has been submitted in this case.There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is not

Patna High Court Cr.Misc. No.35468 of 2016 (4) dt.24-10-2016 2/2 named in the FIR. There is no recovery of any incriminating article from the possession of the petitioner. Except confessional statement of co-accused, there is no other substantive material to suggest the implication of the petitioner in the present case. On behalf of the State, it has been submitted that the petitioner is not named in the FIR.

Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in connection with Mehadia P.S.Case No.133 of 2015.
