Mr. Shyameshwar Dayal ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 15-07-2022 Vide order dated 21.01.2022 and 08.06.2022 respectively, the petition of petitioners no. 2, 7 and 8 have already been dismissed as withdrawn.

Heard learned counsel for the petitioners no.1, 3, 4, 5, and 6 learned APP for the State.

The petitioners are apprehending their arrest in a case

Patna High Court CR. MISC. No.65760 of 2021(4) dt.15-07-2022 2/3 registered for the offences punishable under Sections 147, 149, 341, 323, 504, 506, 201, 379, 411, 353 and 337 of the Indian Penal Code and Sections/Rule 11, 18 and Rule 56(1), 56(2) and 56(4) of the Bihar Minor Mineral (Concession Prevention of Illegal Mining Transportation & Storage) Rule, 2021. The matter relates to illegal and mining transportation of sand and the accused persons including the petitioners indulged in scuffling and snatching the tractor loaded with sand and rifle of the police force.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that from perusal of the FIR, it is clear that no marpit took place with the police party neither any injury to any one nor they had tried to snatch their rifle and other things. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, namely, Sanjay Singh @ Sanjay Kumar, Ranjeet Singh, Bhola Yadav @ Bhola Kumar, Pawan Kumar and Saroj Yadav @ Saroj Kumar, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds

Patna High Court CR. MISC. No.65760 of 2021(4) dt.15-07-2022 3/3 of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Rohtas at Sasaram in connection with Tilauthu P.S. Case No. 125 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
