The petitioner seeks bail in Azamnagar P.S. Case No. 107 of 2017 instituted for the offence under Section(s) 30(a) of the Bihar Prohibition Excise Act, 2016.

As per written report, petitioner was found carrying 106 bottles each containing 600 ml. country-made liquor of Bengal made.

It has been submitted that the petitioner has no criminal antecedent.

From the impugned order it appears that the petitioner is in custody since 07.03.2017.

In the facts and circumstances of the case and period

Patna High Court Cr.Misc. No.24190 of 2017 (2) dt.22-05-2017 2/2 of custody, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of 2nd Additional Sessions Judge-cum-Special Judge, Katihar in connection with Azamnagar P.S. Case No. 107 of 2017, subject to the condition that both the bailors shall be the close relative of the petitioner and the petitioner will file an affidavit before the court below that he will not indulge in such type of offence in future otherwise, his bail bonds will be cancelled.
