2. The petitioner is apprehending his arrest in connection with Udakishunganj P.S. Case No. 346 of 2019, registered for the offence punishable under Sections 147, 148, 149, 341, 323, 325, 307, 379, 354 and 504 of the Indian Penal Code.

3. After some arguments, learned counsel for the petitioner submits that the other co-accused persons, namely, Ramdayal Mahto and Hare Krishna Mahto @ Kari Mahto, have already been allowed regular bail by the Court below. He

Patna High Court CR. MISC. No.55745 of 2023(2) dt.30-08-2023 2/2 submits that the case of the instant petitioner is on a better footing than that of those two persons. He would be raising this issue while availing the remedy of regular bail on surrender in the Court.

4. The Court, therefore, would allow the petitioner to avail the benefit of such submission at the time of his prayer for regular bail in the Court below at the time of his surrender.

5. With liberty, as prayed for, the application is disposed of.
