JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 399, 402, 414 of the Indian Penal Code and Section 25(1b)a 26, 35 of the Arms Act. Petitioner is languishing in jail custody since 29.3.2016 on the accusation that he was caught by the informant along with others when they had assembled to make preparation for committing dacoity and one country made loaded katta and mobile phone were recovered from his conscious possession. Submission on behalf of the petitioner is that no such occurrence as alleged in the F.I.R. had taken place and, moreover,

Patna High Court Cr.Misc. No.28205 of 2016 (3) dt.27-09-2016 2/2 investigation against the petitioner has already been completed. It is further submitted that so far as criminal antecedent of the petitioner is concerned, Siwan Muffasil P.S. Case No.116 of 2016 was lodged against the petitioner on the same day when the present case was lodged and except the aforesaid case as well as present one, petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Siwan in connection with Siwan Muffasil P.S. Case No.115 of 2016.
