The Petitioner seeks bail in Araria P.S. Case No.85 of 2017 instituted for the offence under Section(s) 272, 273/34 Indian Penal Code and Sections 30, 36, 38 of the Bihar Excise Amendment Act.
From the written report as well as seizure list, it appears that 180 bottles of Codein Cough Syrup each of 100 ml. was recovered from the garage of co-accused Md. Mokim. This petitioner is alleged to be present at the place of occurrence. It has been submitted that the petitioner is in custody since 16.02.2017 having clean antecedents.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner,
Patna High Court Cr.Misc. No.24226 of 2017 (2) dt.24-05-2017 2/2 above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria, in connection with Araria P.S. Case No.85 of 2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
