JUSTICE RAKESH KUMAR ORAL ORDER 17-08-2016 Heard Sri Manish Kumar No. 2 , learned counsel for the petitioner and Sri Satyendra Narain Singh, learned A.P.P. The petitioner, who is in custody since 8.6.2016 in Patna Rail P.S. Case No. 138 of 2016 registered for the offence under section 47(a) of the Bihar Excise Act , has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that since the petitioner refused to be a seizure evidence, he has been made accused in the case showing recovery of about 30 liters of foreign make wine.
Patna High Court Cr.Misc. No.32087 of 2016 (2) dt.17-08-2016 2/2 Learned Additional Public Prosecutor has opposed the prayer for bail.
However keeping in view the nature of accusation and period of custody, let the petitioner Abhishek Kumar Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Patna / concerned court in connection with Patna Junction Rail P.S. Case No. 138 of 2016.
