Petitioners seek bail in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Sections 30(A), 37(B) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

123 litres of foreign liquor was, allegedly, recovered from the vehicle of the petitioners. The petitioners are in custody since 26.02.2017 and they have stated on oath that they have got no criminal antecedent.

Considering the aforesaid facts, let the petitioners, above named, be released on bail on furnishing bail bonds of

Patna High Court Cr.Misc. No.24115 of 2017 (3) dt.20-06-2017 2/2 Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned 2nd Additional & Sessions-cum-Special Judge (Excise), Purnea/successor Court in connection with Special Case No. 101 of 2017 arising out of K. Hat (Sahayak) Police Station Case No. 103 of 2017, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners with further condition that the petitioner shall file undertaking before the court below that they would not involve in such activity in future. If the court below would come to the notice of such involvement of the petitioners that would be a ground for cancellation of bail by the court below in that case also.
