Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 25(1-B)A , 26, 35 of Arms Act.
The allegation against the petitioner is that one country made loaded pistol has been recovered from the possession of the petitioner.
It is submitted on behalf of the petitioner that the petitioner is in custody since 29.09.2015.Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is further submitted that one country made pistol is said to have been recovered from the
Patna High Court Cr.Misc. No.24283 of 2016 (3) dt.08-08-2016 2/2 possession of the petitioner. No compliance of Section 100 Cr.P.C. has been followed.
On behalf of the State, it is submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Pushpendra Kumar Pandey, learned Judicial Magistrate,1st Class, Begusarai in connection with Ballia P.S.Case No. 343 of 2015.
