The petitioner seeks regular bail in connection with Sikandaa P.S.Case No.2 of 2017 registered for offences punishable under Sections 406, 409, 467, 468, 471 and 120(B) of the Indian Penal Code.
As per FIR there is allegation against the petitioner who happens to be Mukhiya of the Gram Panchayat that he along with the Panchayat Secretary has defalcated the public money to the tune of Rs.23 lac.
Submission of the learned counsel for the petitioner is that the Panchayat Secretary is the main person in this case and he has been granted bail by a Co-ordinate Bench of this Court, vide order dated 27.11.2017 passed in Cr. Misc. No.56141 of
Patna High Court CR. MISC. No.51592 of 2019(4) dt.16-11-2019 2/2 2017. Petitioner is in custody for more than four months. He is ready to abide by any condition imposed upon him. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned M.K. Pandey, J.M. Ist Class, Jamui in connection with Sikandara P.S.Case No.2 of 2017 dated 3.1.2017 with condition to co-operate in the investigation..
With the above direction, this application is allowed.
