In this case, the petitioner is seeking bail in connection with Kotwali P.S. Case No. 125 of 2016 (S.T. No. 367 of 2016) registered for offences under sections 379, 411, 413/34 of the Indian Penal Code.
From the First Information Report, it appears that the Informant had kept his motorcycle in front of Girdhari Sah Hatiya. When he returned, he did not find his motorcycle, the shopkeeper informed that a lean and thin boy has taken away the motorcycle. On chase, the motorcycle was identified and that fellow tried to escape but was apprehended. He disclosed the name of the petitioner and said that he used to sale motorcycle to the petitioner
Patna High Court Cr.Misc. No.27241 of 2016 (2) dt.15-07-2016 who is running a garage. The petitioner use to sell parts of the motorcycle.
Learned counsel for the petitioner has submitted that no recovery has been made. Only the statement of the co-accused that he used to sell motorcycle cannot be a ground for implicating the present petitioner. The petitioner has criminal antecedent. The petitioner is languishing in judicial custody since 28.3.2016. Looking to the facts and circumstances of the case, let the petitioner, namely, Md. Jawed Anwar, be released on bail 16.8.2016 on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned IIIrd Additional District and Sessions Judge, Bhagalpur in connection with S.T. No. 367 of 2016 arising out of Kotwali P.S. Case No. 125 of 2016.
