JUSTICE ARUN KUMAR ORAL ORDER 14-06-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner, already in custody, seeks bail in connection with Sono P.S. Case No.150 of 2016, registered under Sections 272/273 of the Indian Penal Code as well as Sections 47/47(A)/(5)/53 of the Bihar Excise Amendment Act, 2016. Allegation in brief is that police on secret information intercepted two vehicles on the road and from the vehicle of the petitioner 107 bottles of foreign liquor as well as 80 pieces of plastic coated boxes each containing 180 ml. of foreign liquor of Officer's Choice brand was recovered. The owner of the vehicle as well as the driver was made accused in this case. Learned counsel for the petitioner submits that petitioner is the owner of the vehicle and he was not moving with

He was also not apprehended at the spot so the recovery is not from his conscious possession and has got clean antecedent and another co-accused of this case has been granted bail by a coordinate Bench of this Court.
Considering the said facts and circumstances, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Sono P.S. Case No.150 of 2016.
