This is a case registered under Section 401 of the Indian Penal Code in connection with Kotwali (Tilkamanjhi) P.S. Case No. 184/2017.
It has been submitted on behalf of the learned counsel for the petitioner that there are some cases pending against the petitioner from before and in all cases the petitioner is on bail. It has further been submitted that from perusal of the F.I.R. itself, it appears that the petitioner apprehended on suspicion. From his possession one Khanti was recovered and that recovery was also not made in presence of any independent
Patna High Court Cr.Misc. No.30085 of 2017 (2) dt.06-07-2017 2/2 witness. There is no allegation against the petitioner for recovery of any stolen article. Further, he is in custody since 20.04.2017. In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur in connection with Kotwali (Tilkamanjhi) P.S.
