The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 342, 323, 307,
Patna High Court CR. MISC. No.57064 of 2022(3) dt.17-02-2023 2/3 302/34 of the Indian Penal Code.
The prosecution case in nutshell is that when the son of informant was returning to home, petitioners surrounded him and assaulted by means of lathi, due to which he succumbed to injuries.
It is submitted by learned counsel for the petitioners that the petitioners are innocent and they have committed no offence. They have falsely been implicated in the present case due to previous enmity. There is general and omnibus allegation against them and there is no specific overt act of allegation levelled against the petitioners. It is also submitted that petitioners are languishing in judicial custody since 03.06.2022.
Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer for Bail and submitted that three lacerated and other abrasion wound have been found on the person of deceased. Doctor has opined the cause of

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Katra P.S. Case No. 204 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Muzaffarpur (East).
