The petitioner seeks bail in a case instituted under Sections 25(1-b) A & 26 of the Arms Act.
It is alleged that seven live cartridges, two empty cartridges of gun, two empty cartridges along with four live cartridges of rifle are said to have been recovered from the house of the petitioner. No valid document had been produced by the petitioner with regard to the alleged recovered articles. Accordingly, seizure list was prepared.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 25.11.2016. The charge sheet has been submitted in the present case. The petitioner has got no
Patna High Court Cr.Misc. No.24590 of 2017 (2) dt.30-05-2017 2/2 criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is further submitted that nothing incriminating article has been recovered from the conscious possession of the petitioner. The petitioner has been made accused due to mistake of fact.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Judge-9th-cumA.C.J.M., Muzaffarpur, in connection with Siwai Patti P.S. Case No. 41 of 2015.
