The petitioners seek bail in a case registered under Sections 341, 323, 324, 302/34 of the Indian Penal Code. The prosecution case in brief is that the accused persons came at the door of the informant and started abusing. On protest, the accused persons caught having caught hold of the informant's husband, assaulted him and pressed his neck as a result of which, he died.

It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no

Patna High Court CR. MISC. No.50778 of 2019(4) dt.16-11-2019 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners are in custody since 25-05-2019. Charge sheet has already been submitted. The main allegation of assault is alleged against the co-accused Heman Singh who is said to have assaulted the deceased with SAWAL. Petitioners are ladies. The petitioners have been falsely implicated in the present case. The other co-accused with similar allegation have been granted bail by a coordinate bench of this court vide order dated 01-10-2019 passed in Cr. Misc. No. 54010 of 2019. On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioners named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Vaishali at Hajipur in connection with Desari P.S.
