The petitioner is in custody since 08.04.2017 in connection with Sirdalla P.S. Case No. 12 of 2017, registered for offences punishable under Sections 272 and 273 Indian Penal Code and Sections 30(a) Bihar Prohibition and Excise Act, 2016. Allegation against the petitioner is of recovery of 50 litres of Mahua liquor.

It has been submitted on behalf of the petitioner that petitioner has falsely been implicated in this case, which will appear from the fact that the seizure list witnesses are not the independent witnesses rather member of raiding party are seizure list witnesses. Further petitioner has not been apprehended from

No.24635 of 2017 (2) dt.29-05-2017 2/2 the spot and also nothing has been recovered from his conscious possession and the place from which the alleged recovery has been made, also does not belong to the petitioner. Petitioner has no criminal antecedent and has been in judicial custody since 08.04.2017.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the facts and circumstances of the case and also that petitioner has no criminal as such, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Nawada, in connection with Sirdalla P.S. Case No. 12 of 2017.
