JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 394, 302 of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is not named in the first information report and it would appear from perusal of the case diary that in course of investigation, some co-accused were arrested and confessed that they had sold the looted motorcycle of the present case to petitioner and after that the looted motorcycle was recovered from the house of the petitioner. The aforesaid fact is corroborated from perusal of para-40 and other paragraphs of the case diary. Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.24570 of 2016 (3) dt.18-07-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, (West) Muzaffarpur in connection with Kanti P.S. Case No. 592 of 2015.
