NILU AGRAWAL ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in jail since 04.03.2016 in a case registered for offences punishable under Sections 147, 148, 149, 341, 342, 323, 386, 379 and 504 of the I.P.C. and 3/4 of the Explosive Substance Act and 17 of the C.L.A. Act. The prosecution case is that while the informant was working as Security Guard in the C.F.C. company, which was running its business for execution of construction of bridge, some Maowadi came in the night and threatened and snatched money and mobile of the informant and other Security Guard. It has been submitted by the learned counsel for the petitioner that he is not named in the F.I.R. but during the course of investigation and on the basis of confessional statement of one

Patna High Court Cr.Misc. No.10703 of 2017 (3) dt.20-06-2017 2/2 Kishori Mahto @ Munni Baba and other accused, his name has surfaced as he was member of a Maowadi group, established by one Arbind Kumar Verma. He further submits that the said accused Arbind Kumar Verma has been granted bail by a Coordinate Bench of this Court in similar case passed in Cr. Misc. No. 23786 of 2012 dated 14.09.2012 and other co-accused, not named in the F.I.R. have also been granted the privilege of bail, which is Annexure-2 series. He further submits that the petitioner has been implicated mainly on the basis of suspicion. However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstance of the case and materials on record , let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction of learned Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S.Case No. 202 of 2010.
