The petitioner is languishing in custody in connection with Ekangarsarai P.S. Case No. 42 of 2016 for the offences instituted under Sections 279 and 302/34 of the Indian Penal Code. The prosecution story in brief is that, on 02.03.2016 at about 2.30 hours, when the informant along with deceased were going to the maternal home, in the meantime, two motorcycle borne criminals came there and dashed the deceased, as a result of which, he fell down and thereafter one of the miscreants, who was sitting behind the motorcycle started assaulting upon the deceased with iron rod upon his head, as a result of which, he died. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.23664 of 2016 (4) dt.05-08-2016 2/2 petitioner is in custody since 03.03.2016. Final form has been submitted against the petitioner and charge sheet has been submitted against the co-accused under Section 304A of the Indian Penal Code. Admittedly, it is a case of an accident. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Ekangarsarai P.S. Case No. 42 of 2016.
