The petitioner seeks bail in Taraiya P.S. Case No. 23 of 2014, corresponding to Sessions Trial No. 56 of 2016, registered for the offences punishable under Sections 302, 307 and some other Sections of the Indian Penal Code and under Section 27 of the Arms Act.

Learned counsel for the petitioner submits that prayer for bail of the petitioner was earlier thrice rejected by this Court. The petitioner Mannu Chaubey is alleged to have fired which caused injury to the informant Pankaj Chaubey. Mukesh Choubey is alleged to have pierced Barchhi in the abdomen of Krishna Choubey who died. On the last occasion prayer for bail of the petitioner was rejected on the ground that the trial was at its fag

Patna High Court Cr.Misc. No.24185 of 2017 (2) dt.21-06-2017 2/2 end. It is further submitted that after examination of the witnesses the informant filed petition under Section 311 of the Code of Criminal Procedure for examination of other witnesses. The petitioner is in jail since 21.03.2014. The petitioner has already remained in jail for more than three years for the allegation that he fired causing injury to the informant who is still alive. The petitioner is not the assailant of the deceased Krishna Choubey. Considering the facts aforesaid the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge8th, Saran at Chapra in Taraiya P.S.
