====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-07-2023 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned senior counsel appearing on behalf of informant/opposite party no. 2.
2. The petitioner apprehends his arrest in a case registered for the offence under Sections 323, 498(A) of the Indian Penal Code and Section 3 / 4 of Dowry Prohibition Act.
3. In this case, a supplementary affidavit has been filed on behalf of petitioner on 14.07.2023 and in paragraph - 8, it is stated that petitioner is ready to make a fixed deposit (F.D.) of an amount of Rs. 15,00,000/- (Rupees fifteen lacs) for the education purpose of his daughter.

Learned counsel for the petitioner submits that petitioner is still ready to keep informant, as his wife with full honour, and as such, he has filed a case, vide Matrimonial Case No. 317 of 2022, for restitution of conjugal rights, which is pending before learned Principal Judge, Family Court Patna.
5. Learned counsel for the informant, though opposes the prayer for anticipatory bail of petitioner, but accepts the proposal of petitioner of F.D. of Rs. 15,00,000 for education purpose of daughter of opposite party no. 2.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna in connection with Mahila P.S. Case No. 42 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner shall deposit F.D. of Rs. 15,00,000/-, as aforesaid, at the time of furnishing bail-bond.
