2. The petitioner seeks bail in connection with Chakiya P.S. Case No. 135 of 2023 registered for the offence punishable under Sections 395 and 397 of the Indian Penal Code.

3. Unknown criminals committed dacoity in the Bank and looted Rs. 48 lakhs. Two lakhs looted amount has been recovered from the petitioner. Apart from the recovery, the petitioner has given a self inculpatory statement confessing his guilt.

4. The petitioner is in custody since 20.04.2023.

5. Considering the gravity of the offence, this Court is

6. Accordingly, the application stands dismissed.

7. During the course of argument, it has been submitted by learned counsel for the petitioner that in the trial, witnesses are not being examined though the charge was framed on 20.05.2024 and from the report of the trial Judge, it appears that the witnesses are not appearing in the trial.

8. In these circumstances, the Superintendent of Police, East Champaran, Motihari is directed to ensure the attendance of the witnesses in the trial so that the trial proceeds.
