The petitioner is accused in connection with Mojahidpur P.S. Case No. 17 of 2016, registered under Sections 420, 467, 468, 471, 472 and 120(B) of the Indian Penal Code and Section 43, 66, 66(C) and 66(D) of the Information Technology Act, 2000.
The accusation is that the Police received secret information about indulging of petitioner and five others in transferring the money through Hawala to Pakistan and Saudi Arabia and also cheating the innocent people. On search, a passbook of Axix Bank, ATM Cards of different banks and Statement of account of State Bank of India, Kargil Branch, Kargil were recovered from the possession of the petitioner. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case merely on
Patna High Court Cr.Misc. No.27808 of 2016 (2) dt.13-07-2016 2/2 suspicion. Further submission is that after investigation, Chargesheet has already been submitted. Further submission is that similarly situated co-accused Gopal Goyal @ Gopal Kumar Goyal @ Gopal Kumar, Md. Parwej Ansari @ Parwej Akhtar, Navin Kumar Sah @ Navin Kumar and Pawan Kumar @ Pawan Gupta have already been granted privilege of bail by a coordinate Bench of this Court vide order dated 04.07.2016 passed in Criminal Misc. No. 18322 of 2016, Criminal Miscellaneous No.20128 of 2016 and Criminal Miscellaneous No.20894 of 2016, respectively. The petitioner having no criminal antecedent is in custody since 23.01.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in connection with Majahidpur P.S. Case No. 17 of 2016. Out of two sureties, one surety must be the parents/close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
