Petitioner is accused in connection with Muzaffarpur P.S. Case No.24 of 2016 registered under Section 47 of the Bihar (Amendment) Excise Act.

The accusation is that one person was seen in red colour motorcycle having three Plastic Jars near platform no.6 of the Railway Station, Muzaffarpur. On suspicion, the Police started moving at the Platform then they started to flee away, but the petitioner was caught hold, who disclosed that he had come to supply of Toddy for sale to Rajendra Paswan. The Police recovered 210 liter Toddy and 21 empty bottles of beer concealed in the bush on disclosure of the petitioner.

No.27822 of 2016 (2) dt.13-07-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that the alleged Toddy and empty bottles were recovered to the bush, which would appear from the seizure list and the F.I.R., but the Police apprehended the petitioner, who was passing over nearby the bush on motorcycle. Petitioner has no criminal antecedent and is in custody since 15.04.2016. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of J.M, Rail, Sonepur, Saran in Muzaffarpur P.S. Case No. 24 of 2016 (G.R. No. 72 of 2016). Out of two sureties, one surety must be parents or close relatives of the petitioner.
