Petitioner seeks bail in a case registered under section 364 of the Indian Penal Code.
Petitioner is not named in the first information report but subsequently, he was arrested with Scorpio vehicle bearing registration no. JH 10C/9128 which has been used in committing the alleged crime and after that statement of the owner of the aforesaid vehicle was recorded at para 19 of the case diary and the said witness stated that on 6.1.2016 the petitioner came and took away the vehicle. Investigation against the petitioner has already been completed and except the aforesaid material, there appears to be nothing against him. Moreover, both victims have already returned to their home and the petitioner is in jail custody since 10.1.2016 but up till now he
Patna High Court Cr.Misc. No.24169 of 2016 (3) dt.14-07-2016 has not been put on test identification parade. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Vishnupad P.S. Case no. 05/2016.
