2. The petitioner is in custody since 03.04.2016 in connection with Ramgarhwa P.S. Case No. 21 of 2016 for the alleged offences under Sections 272, 273, 290 of the Indian Penal Code and Section 47(a) of the Excise Act.

3. It is submitted that the petitioner has been falsely implicated and nothing was in fact recovered from the conscious possession of the petitioner nor from the alleged shop belonging to the father of the petitioner Chhotelal Prasad.

4. Having regard to the nature of accusations and the gravity of offence relating to the alleged occurrence having transpired after the recent amendment to the Bihar Excise Act, this
