JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-06-2017 The appellants seek pre arrest bail in connection with Sakra P.S.Case No.94 of 2016 registered for offences punishable under Sections 147, 148, 149, 279, 337, 325, 436 and 302 of the Indian Penal Code and section 3(ii) (v)of SC/ST Act. The allegation against the appellant is that he along with the other accused persons set house of the informant on fire causing injury to the daughter of the informant, who succumbed to the injuries.
It is submitted on behalf of the appellant that there is general and omnibus allegation against the appellant and nothing specific has been attributed against the appellant. Heard learned Special P.P. also, who has opposed the prayer for privilege of bail.
Having heard both sides, in view of the facts and

APP (SJ) No.1133 of 2017 (7) dt.28-06-2017 2/2 circumstances as stated above, this appeal is not maintainable, as such this appeal is dismissed and the appellant is directed to surrender before the Special court and make prayer for regular bail, which will be considered on its own merit by the learned Special Judge without being prejudiced by the order of this Court.
