The petitioners apprehend their arrest in connection with Malsalami P.S. Case no. 26 of 2018, registered under Section 366(A)/34 of the Indian Penal Code. The allegation of informant, Pappu Kumar @ Rahul Kumar is that on 16.01.2018, his daughter Amisha Kumari, aged about 16 years, had gone to the house of her friend, namely, Priyanka Kumari, but she did not return. In course of search, informant came to know that Aryan Raj, brother of Priyanka kidnapped his daughter. Thereafter, he went at the house of Priyanka where her father and other family
Patna High Court Cr.Misc. No.31935 of 2018(2) dt.13-06-2018 2/2 members abused him.
Learned counsel for the petitioners submits that, in fact, daughter of informant left the house due to love affairs with Aryan Raj, son of petitioner No.1, but with ulterior motive, the informant lodged the present case and implicated the petitioners, who are father, sister and brother of Aryan Raj. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-IV, Patna City in connection with Malsalami P.S. Case No. 26 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
