====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 06-09-2016 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are languishing in custody in connection with Azamnagar (Salmari) P.S. Case No. 148 of 2016 for the offences instituted under Sections 392 and 411 of the Indian Penal Code.

The prosecution case, in brief, is that on 17.05.2016 at 3.00 P.M., while the informant went to Katihar Railway Station for withdrawing some money from the ATM with his Scorpio vehicle, the petitioners along with other co-accused came and told him that one person died in his relation and two persons were

No.29769 of 2016 (3) dt.06-09-2016 2/3 coming from Delhi and requested him to provide his vehicle and seeing their condition, the informant became ready to go there but on the way, the petitioners caught hold the informant and tied his hand and mouth and threatened him to dire consequences but suddenly they stopped the vehicle and tried to flee away but they were caught hold by the police. It is further alleged that one loaded country made pistol along with one live cartridge and mobile were also recovered from the possession of the petitioners. It has been submitted on behalf of the petitioners that the petitioners are in custody since 19.05.2016. The charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioners.

The petitioners have been made accused due to dispute regarding the payment of hired vehicle in question. The vehicle in question has already been recovered. It is further submitted that the petitioners may be released after completion of 8 (eight) months in custody i.e. from 19.05.2016.

On behalf of the state it has been submitted that the petitioners are named in the First Information Report. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail after completion of 8 (eight) months in custody i.e. from 19.05.2016 on furnishing
