The petitioner seeks bail in connection with L.N.M.U. P.S. Case No. 280 of 2019 registered for the offence under Sections 272, 273 and 34 of the Indian Penal Code, Section 20, 22 of the N.D.P.S. Act and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Recovery is of total 76 litres of illicit liquor from the possession of the petitioner. The recovery of Ganja is from co-accused.

Learned counsel for the petitioner submits that the petitioner is in custody since 09.05.2023.

Considering the period of custody and the recovery

Patna High Court CR. MISC. No.56497 of 2023(2) dt.30-08-2023 2/2 of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Session Judge-cum-Special Judge, Darbhanga in connection with L.N.M.U. P.S. Case No. 280 of 2019. The petitioner will visit L.N.M.U. Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.
