Mr.Md. Nazir Ansari ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 23-08-2024 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Aurangabad Excise P.S. Case No. 627 of 2024 for the offences punishable under Sections 30(a), 32(3), 41(1) and 41(2) of Bihar Prohibition and Excise (Amendment) Act, 2016 and 2018.

3. As per allegation, on a secret information, the informant along with other police personnel reached to the place of occurrence. Having seen the police party, though the petitioner tried to flee away, but he was apprehended. On search, 198.270 liters of illicit liquor was recovered from the vehicle.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. He has further submitted that nothing was recovered

Patna High Court CR. MISC. No.60117 of 2024(2) dt.23-08-2024 2/2 from possession of the petitioner. He has also submitted that the petitioner is the driver of the vehicle in question. The petitioner is a person of clean antecedent and is under custody since 27.06.2024.

5. On the other hand, learned APP For the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances as well as clean antecedent of the petitioner, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise-II, Aurangabad in connection with Aurangabad Excise P.S. Case No. 627 of 2024, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
