JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-04-2015 Petitioner is languishing in custody since 02.10.2012 in a case registered for the offences punishable under Sections 392, 411 of the Indian Penal Code. The accusation is robbing mobile phones, gold chain, cash, watches and other articles of the informant. The First Information Report was registered against unknown. The name of the petitioner sprang up during investigation. Subsequently the petitioner made confession.

It is submitted by learned counsel for the petitioner that neither any recovery was made from the petitioner nor the petitioner has been roped in the present case. Though the petitioner is accused in one other case apart from the present one.

Considering the fact that neither any recovery has been made nor the petitioner has been put on test identification parade, let the petitioner, above named, be

No.28826 of 2014 (6) dt.27-04-2015 2/2 released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Morkahi P.S. Case No. 100 of 2012, G.R. No. 1909 of 2012.
