JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-02-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Wazirganj P.S. Case No. 453 of 2015 registered under Sections 395 and 397 of the Indian Penal Code.

The accusation is that the petitioner is not named in the First Information Report but in course of investigation, one Gautam Kumar confessed about commission of the theft of present case along with others. He further disclosed that articles of theft have been kept in the Self Help Group godown after taking the key from the petitioner. The wife of the petitioner is a member of Panchayat Samiti and with the help of Panchayat Samiti, the godown was constructed. Except taking the key of SHG godown

Patna High Court Cr.Misc. No.1575 of 2016 (3) dt.19-02-2016 2/2 to keep the theft articles by the co-accused, Gautam Kumar, there is nothing against the petitioner and petitioner has no criminal antecedent.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Wazirganj P.S.
