The petitioner apprehends his arrest in connection with Kunauli (Dagmara O.P) P.S. Case no. 24 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The accusation is that on receiving secret information about carrying of Nepali Soufi loading on motorcycle from Nepal to Sikarhatta, the informant along with other Police personnel reached at Naya Tola, Sikarhatta Bandh. In the meantime, two persons were seen on motorcycle having a plastic sack. When the signal was given to stop the motorcycle then both succeeded to flee away leaving the motorcycle and on search of sack, 145 bottles, each containing 300 MLNepali Soufi recovered. No.52013 of 2019(2) dt.21-08-2019 2/2 motorcycle bearing registration No. BR-50F-3766, paper of motorcycle was recovered in which the name of owner of the motorcycle was shown as Ravindra Kumar Yadav (Petitioner). Learned counsel for the petitioner submits that, in fact, the motorcycle of the petitioner was taken by his villager Chandan Yadav, son of Ram Chandra Yadav for personal use and the petitioner had no knowledge about carrying of alleged liquor on his motorcycle. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-IIcum-Special Judge, Excise Act, Supaul in connection with S.Tr Excise No. 348 of 2019, arising out of Kunauli (Dagmara OP) P.S. Case No. 24 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
