Petitioners apprehend arrest in connection with Manigachhi P.S. Case No.226 of 2017 registered for the offences under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code.
It has been submitted that the petitioners and the informant both deal in banana business at Sakri market in the district of Khagaria where in course of business transaction, an occurrence of assault took place. In the said occurrence, the father of the petitioners sustained fracture injury and was treated at D.M.C.H. The injury report of the father of the petitioners is
Patna High Court Cr.Misc. No.20793 of 2018 (2) dt.03-05-2018 annexed as Annexure 2 to this application. The informant in the said occurrence sustained simple injury which is apparent from the injury report as annexed with this application. The learned A.P.P. for the State opposed the submission. Considering the facts and circumstances of the case, the prayer for anticipatory bail is allowed and the above named petitioners, in the event of arrest or surrender before the learned court below within six weeks from today, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the likewise amount each to the satisfaction of learned A.C.J.M. VI, Darbhanga in connection with Manigachhi P.S. Case No.226 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. (Sanjay Kumar, J) Harish/- U
