NILU AGRAWAL ORAL ORDER 20-06-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in jail since 29.01.2017 in a case registered for offences punishable under Sections 341, 324, 307, 379 and 504/34 of the Indian Penal Code. The prosecution case as lodged by the informant is that there was a dispute between the informant and the petitioner regarding damaging the egg shop for which the petitioner is alleged to have hit the informant on his head by Farsa and other accused persons also assaulted the informant. It has been submitted by the learned counsel for the petitioner that he is innocent and although, charge sheet has been

Patna High Court Cr.Misc. No.15571 of 2017 (3) dt.20-06-2017 2/2 submitted against the petitioner under Section 307 of the I.P.C. but medical report after C. T. Scan dated 19.05.2017, which is Annexure- 6 of the supplementary filed by the petitioner indicates that the injury has been found to be simple in nature. Learned A.P.P. for the State however submits that the petitioner has inflicted injury on the head of the informant, hence, opposes the prayer for bail.

Considering the facts and circumstance and the materials on record, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each the to the satisfaction of learned Chief Judicial Magistrate Bettiah, West Champaran in connection with Bettiah (T) P.S.Case No. 74 of 2017 with a condition that the petitioner will appear before the learned Court below on each and every date and failure to appear before the Court below on two consecutive dates without assigning any reason will entail cancellation of his bail bonds.
